How rent increases work in Quebec
Quebec does not set a single percentage cap the way most provinces do. The Tribunal administratif du logement publishes percentages each year under the Regulation respecting the criteria for fixing rent, and a landlord applies them to the actual costs of the building.
For 2026 the base rent percentage is 3.1%, services tied to the tenant are 6.7%, and capital expenditures are 5%. For notices given on or after 1 January 2026 the tribunal also publishes percentages for electricity at 2.9%, gas at 13.7%, oil and other energy at 4.9%, maintenance costs at 5.7%, building service costs at 3.4%, management fees at 7.2%, net income at 5.7%, and capital expenditures at 4%. The tribunal provides a calculation tool for 2026.
Notice periods for changing a lease in Quebec
Quebec works on fixed notice windows rather than a single period. For a lease of 12 months or more, notice is given between 3 and 6 months before the end of the lease. For a lease of less than 12 months it is between 1 and 2 months. For a lease with no fixed term it is between 1 and 2 months before the proposed change. For a room rental it is between 10 and 20 days.
Notice has to be in writing and sent by a method that gives proof of receipt. The tenant then has one month from receiving it to respond, and silence counts as acceptance.
A Quebec lease renews automatically without any notice being required, which catches owners from other provinces out.
What changed in Quebec in 2026
Changes to the lease forms came into force on 1 January 2026. Printed forms sold before that date stay valid until 31 December 2026, and the tribunal offers a free adjustment annex in the meantime.
Amendments to the Act respecting the Tribunal administratif du logement came into force on 12 June 2026. Proof of notice of an application must now be filed within 45 days, and failing to do so no longer causes the application to lapse.
A new fee schedule took effect on 1 November 2026. Applications to fix rent, modify a lease condition, or reduce or review rent cost $60 where rent is $350 or less, $72 where rent is over $350 and up to $600, and $94 where rent is over $600. Re-entry on the roll and re-opening a hearing cost $48. Non-payment applications, relocation and damages claims and other applications cost $94. People receiving last-resort financial assistance are exempt.
Separately, Bill 65, sanctioned in June 2024, bars eviction for subdivision, enlargement or change of use for three years.
